Who Are We

These Terms of Service ("Terms") apply to all orders placed through this website (the "Store"). The Store is operated by, and your contract is concluded with:

- referred to as "we", "us", or the "Publisher". XPUNKS GmbH is the publisher and seller of record for all products offered on this website; "Fuzzycards" is a brand of XPUNKS GmbH. This section also serves as our legal notice (Impressum).

Scope

These Terms govern (a) purchases of physical products against payment, including pre-orders and

presales, and (b) redemptions of digital collectibles (NFTs) for physical products, where only shipping costs are charged. By placing an order you accept these Terms.

These Terms do not govern the purchase or sale of NFTs on third-party marketplaces (e.g.,

xrp.cafe) or peer-to-peer. Such transactions are subject to the terms of the respective marketplace, and we are not a party to them.

Eligibility

By ordering, you confirm that you are at least 18 years old or have the consent of a legal guardian, and that you are purchasing for personal use as a collector. We may limit order quantities per customer and refuse orders that appear to be placed for commercial resale purposes.

Products

We sell physical trading cards and related collectibles under the Fuzzycards brand. Product images are illustrative; minor variations in print, color, cut, centering, and finish are inherent to trading card production and do not constitute defects. Randomized products (e.g., sealed packs) contain contents determined by chance within the published set composition; the specific contents of a sealed product are not a product characteristic you can claim against.

Ordering and contract formation

Your order is an offer to purchase. The contract is formed when we send you an order confirmation by email. We may decline or cancel orders at our reasonable discretion, including for suspected fraud, address or payment issues, quantity limits, stock limitations, or destinations we cannot lawfully or practically ship to. Pricing errors: If a price displayed in the Store is manifestly incorrect due to a technical or input error (including currency conversion errors), we may cancel the affected order and refund any payment received, even after an order confirmation has been sent.

Pre-orders and presales

For pre-order and presale products, the delivery date shown is an estimate. Production and delivery timelines for collectible products may shift; delays of up to 90 days beyond the estimated date do not entitle you to compensation. If we become permanently unable to deliver a presale product, we will refund the amount you paid for it; further claims are excluded to the extent permitted by law. Statutory withdrawal rights for EU/EEA/UK consumers remain unaffected.

NFT redemption orders

Where a product is obtained by redeeming (burning) an NFT:

The redemption is final once the NFT burn is confirmed on-chain. Burned NFTs cannot be restored, by us or anyone else.
You pay only the shipping and handling fee shown at checkout.
Each eligible NFT entitles you to one redemption of the corresponding product.
You are solely responsible for the security of your wallet and for executing the burn transaction correctly. We are not responsible for redemption attempts from wallets you do not control, transactions sent to incorrect addresses, or losses caused by phishing, compromised wallets, or user error.
We do not operate the XRP Ledger or any wallet software or marketplace. We are not liable for blockchain network congestion, downtime, forks, transaction failures, or the acts or omissions of third-party wallet or marketplace providers.

Prices and payment

Prices are shown at checkout in the displayed currency. Payment is processed at checkout via the payment methods offered there. For deliveries to Switzerland, Swiss VAT (8.1%) is included where applicable, including on shipping. For deliveries to other countries, local import duties, customs fees, and taxes may apply and are the responsibility of the customer unless collected at checkout. Refusal to pay import charges resulting in a return or destruction of the shipment does not entitle you to a refund of shipping costs.

Shipping and delivery

We ship worldwide via third-party fulfillment partners. Estimated delivery times shown at checkout are not guaranteed. Risk passes to you upon delivery. You are responsible for providing a correct and complete delivery address; if a shipment is returned or lost due to an incorrect address you provided, re-shipping costs are borne by you.

Returns and right of withdrawal

Our Returns & Withdrawal Policy forms part of these Terms. In summary: EU/EEA/UK consumers have a statutory 14-day withdrawal right; returns are only eligible for a refund of the product value if the product is unopened, undamaged, and in original sealed condition; opened sealed products are subject to a diminished-value deduction of up to 100%; return shipping is always at the customer's cost. For customers outside the EU/EEA/UK, returns are accepted only for unopened, undamaged products and shipping costs are non-refundable.

Defective products

Statutory warranty rights apply. If you receive a product damaged in transit or an incorrect item, contact us at info@fuzzycards.com within 14 days of delivery with photos of the item and packaging, and we will replace the product or refund you.

Collectible value and no investment advice

Trading cards and NFTs are collectibles. We make no representation or guarantee regarding the current or future market value, liquidity, grading outcome, rarity perception, or resale value of any product or NFT. Nothing in the Store or our communications constitutes financial or investment advice. You purchase for collecting and entertainment purposes.

Liability

To the extent permitted by law, our liability is limited to intent and gross negligence, and in cases of slight negligence to breaches of essential contractual obligations, capped at the value of your order. We are not liable for indirect or consequential damages, loss of profit, or loss of expected collectible value. Mandatory statutory liability (including for personal injury and under product liability law) remains unaffected. Mandatory consumer protection rights in your country of residence remain unaffected.

Force majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, war, strikes, government action, customs delays, carrier failures, blockchain network disruptions, or failures of suppliers and fulfillment partners. Performance deadlines are extended for the duration of such events.

Governing law and jurisdiction

These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Zug, Switzerland. If you are a consumer, mandatory jurisdiction and consumer protection rules of your country of habitual residence remain unaffected.

Final provisions

If any provision of these Terms is held invalid, the remaining provisions remain in effect; the invalid provision is replaced by a valid one that comes closest to its economic purpose. We may update these Terms from time to time; the version in force at the time of your order applies to that order. These Terms constitute the entire agreement between you and us regarding Store orders.
